Terms of Use for Tespit Social

These terms apply to the app Tespit Social by Esat Arslan. They do not apply to the Tespit app itself. If you download Tespit Social from the App Store, Apple's standard licence agreement also applies (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). How data is processed is described in the privacy policy for Tespit Social (https://tespitapp.com/en/datenschutz-social).

• You can view and analyse your trips without an account. Friends, groups, reactions and leaderboards need an account.
• You must be at least 16 years old to create an account.
• An account belongs to one person. Do not pretend to be someone else, and only use your own trips.
• You can delete your account in the app at any time.

Other people see your user name, profile picture, bio, group names and reactions. Not allowed are:

• offensive, discriminatory, hateful or threatening content
• harassing, bullying or stalking other people
• sexual, violent or otherwise objectionable content
• advertising, spam, links and content that infringes the rights of others
• photos of other people without their consent
• false or manipulated trips to influence leaderboards

The app automatically checks user names, bios and group names for offensive words. This does not replace your responsibility for your content.

• You can report any person from their profile (name, photo, bio or other) and block them. Blocked people can no longer send you requests and cannot see your trips.
• Reports are usually reviewed within 24 hours. Content that breaks these terms is removed; the responsible account may be suspended or deleted.
• You can leave a group at any time; whoever created a group can remove members or end the group.

Tespit Social has zero tolerance for child sexual abuse and exploitation (CSAE), including any child sexual abuse material (CSAM).

• Any content that sexualises, endangers or exploits children is prohibited, as is any contact with minors for such purposes (grooming).
• Accounts are only allowed from age 16. There is no chat and no private messaging; contact only happens through mutually confirmed friendships and invite-only groups.
• Report such content in the app with "Report" on the profile or by e-mail to TespitApp@gmail.com. I remove it immediately, permanently ban the account and report the case to the competent authorities.

• Energy, consumption, regeneration and costs are estimates from your vehicle's values and are not official figures.
• There is deliberately no leaderboard for speed or acceleration. Always follow the traffic rules.
• Do not use the app while driving.

Tespit Social is free. I aim for reliable operation but cannot guarantee constant availability, and I may change features or end the service. If the service ends, I will announce it beforehand in the app or on tespitapp.com.

I am fully liable for intent and gross negligence and under mandatory statutory provisions. Otherwise liability is excluded as far as the law permits. Tespit Social is an independent app and is not affiliated with Tesla, Inc.

These terms may be updated when features or legal requirements change. I will announce significant changes in the app. Swiss law applies, unless mandatory consumer law of your country of residence provides otherwise.
